Blackridge Property Management Ltd are an agency appointed by Owners’ Management Companies to act on their behalf in managing the common areas.

What is our role under the general data Protection Regulation (GDPR)?

We consider ourselves to be the Data Processor acting on behalf of our clients who are the Data Controller. Both the Data Controller and the Data Processor are subject to the Office of the Data Protection Commissioner, the Supervisory Authority.

How did we get your Personal Data

Information is obtained with the permission of your OMC and processed under strict GDPR guidelines, we would also receive data from you through direct communication via email, website, phone, data collection or feedback forms & cookies (device identifiers, tracking pixels).

Personal data means any information about a living person, where that person either is identified or could be identified. Personal data can cover various types of information, such as name, date of birth, email address, phone number, address, username.

Originally your data was received through the Data Controller from your solicitor on purchase. Subsequently any data received by us was through the Data Controller or directly from you or another Data Processor for the purposes described below.

Note, if information is truly anonymised, irreversibly, and could not be traced back to an identified person, it is not considered personal data.

How we use your Personal Data

Blackridge Property Management acts on instructions and on behalf of the OMC (Owners Management Company). The OMC is the Data Controllers for personal data collected and in compliance with the MUD Act 2011. 

What is the legal basis for processing such data?

We will use your data or personal information (collected by us or a third party i.e. OMC) for the purposes of providing you with contracted services for which you the “data subject” is party.  y [ Article 6 GDPR (1)b ]

Processing is necessary for compliance with a legal obligation to which the Data Controller is subject [ Article 6 GDPR (1)c ]. In this instance an OMC is required by the Companies Act 2014 to maintain adequate accounting records.

Similarly, under the Multi-Unit Developments Act 2011(Mud Act) a unit owner is under an obligation to furnish the owners management company with the below information. Failure to do so would constitute a breach of the MUD Act which could result in civil action.

 • The unit owner(s) name.

 • The unit owner(s) resident address.

• The names of the tenant(s) living in the unit.

• The details of any habitual occupiers of the unit other than tenants.

• Any other contact details that the OMC may reasonably request. It can be suggested that contact details(phone numbers, email addresses) for the owner(s), tenant(s) and emergency contact(s) could be considered a reasonable request.

This includes the provision of property management services to your OMC, service fee payments, site notices on safety & maintenance. It is also to ensure legal compliance with the MUD Act 2011 and Revenue.

OMCs are required by the Companies Act 2014 to maintain adequate accounting records. A unit owner is under an obligation to furnish the OMC with the below information in compliance with the MUD Act 2011. Failure to do so would constitute a breach of the MUD Act.

Where is this data stored?

This data is stored in a database called Blockman which is operated on Amazon Web Services located in Ireland. Data stored and transferred is encrypted. Access is only granted to administrators associated with our office.

What if you sell the property ?

There is still an obligation on the Data Controller to main adequate accounting records, and a list of past and present members of the OMC. However if you sell the property only your name, address and transaction details are necessary to satisfy this requirement. All other contact details are erased.

How long will the data be stored?

Your data will be maintained by us for as long as the contract between the Data Controller and us (The Data Processor) exists or for as long as required by legislation.
 

What are my rights.

You have the right to access your information held by Blackridge Property Management, you also have the right to request a copy of your data, to request a correction to any erroneous data, you have the right to be informed ,you have the right to deletion of data ( if the request does not violate statutory or contractual obligations). You may also lodge a complaint to the controller or Data Commission.

You also have the right to be “forgotten” or have your data withdrawn upon request. However, please refer to the MUD ACT 2011 above pertaining to your legal obligations to the OMC. 

We may ask for further identification in the processing of this request.

Data Breach

In the case of a data breach, the Data Controller shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the Supervisory Authority and Data Subject, if the personal data breach is likely to result in a risk to the rights and freedoms of natural persons.

What are your rights?


You have a right to be informed.
You may request a copy of your data stored.
You may request correction to any erroneous data.
You may request deletion of data, if not in violation of statutory or contractual requirements.
You may lodge a complaint to the controller or object to processing.
You may lodge a complaint to the Supervisory Authority.
You may withdraw consent if processing originally required consent.
What happens in the event of a Data Breach?
